Ellerand operates the website at ellerand.com and the online store on it. These Terms of Service govern your use of the site and any order you place with us. By browsing the site, adding items to a cart, creating an account, contacting us, or placing an order, you agree to these terms. If you do not agree with them, please do not use the site and do not buy from us.

In these terms, "Ellerand", "we", "us" and "our" mean the business that operates ellerand.com. "You" and "your" mean the person using the site or placing an order. "Products" means the cosmetic haircare items we sell, including the Ellerand Curl-Safe Smoothing System.

Please also read our Shipping Policy, our Refund Policy and our Privacy Policy. Those documents form part of these terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in the state, province or country where you live if that age is higher, to place an order with us. By placing an order you confirm that you meet that requirement.

If you are under that age, you may use this site only with the involvement of a parent or legal guardian who agrees to these terms and takes responsibility for the order.

When you order, you also confirm that the payment method you use belongs to you or that you have permission from the account holder to use it, and that the billing and shipping details you give us are accurate and complete. We may cancel an order if we cannot verify this information.

2. Our products

Ellerand sells cosmetic haircare products for external use on hair. The Ellerand Curl-Safe Smoothing System is a set of three items: a 250ml shampoo, a 250ml mask and a 100ml leave in serum. You use it in three steps: wash, mask, serum.

Our products are cosmetics. They are not medical devices and they are not drugs. They are not intended to diagnose, treat, cure or prevent any disease or condition. Nothing on this site, in our emails, or in our advertising is medical advice, and nothing on this site should be used as a substitute for advice from a qualified healthcare professional.

It is worth setting out how the system works, because it defines what we do and do not promise. Hair has an outer layer called the cuticle and an inner core called the cortex. Your curl pattern is set inside the cortex. A salon keratin treatment is a chemical process worked past the cuticle and sealed in with a flat iron at around 450 degrees Fahrenheit, which is why it changes the curl pattern and why you cannot simply wash it back out. Ellerand works entirely on the surface. All five actives in the system, niacinamide, Omega 3-6-8-9, phytosqualane, carbohydrate complex and the smoothing silicone blend, are surface agents. The smoothing silicone blend seals and smooths the cuticle, and because it stays on the surface it never reaches the cortex. That is the reason your curl pattern stays yours. Frizz gone, curls kept.

There is no formaldehyde in the system, no bond breaking chemistry, and no heat or flat iron is needed to get the result.

Please use the products as directed:

• Read the label and the directions on each bottle before you use it, and follow them.

• If you have known sensitivities or a history of reacting to cosmetic ingredients, do a patch test first. Apply a small amount to a small area of skin, leave it, and check the area before you use the product on your whole head. If you are unsure, ask your doctor first.

• Keep the products out of your eyes. If product gets into your eyes, rinse them thoroughly with water.

• Keep the products out of reach of children. The products are for external use on hair only. Do not swallow them.

• Stop using the product and speak to a doctor if irritation, redness, itching or any other reaction occurs.

• Store the products as the label directs, and do not use a product after any date shown on the packaging.

Ellerand is not a chemical straightening treatment and it is not a keratin treatment. It does not permanently alter your curl pattern, and we do not sell it as something that will. If what you want is your curl pattern permanently changed, this is not the product for you, and we would rather tell you that here than after you have paid.

The system is for all hair types. Straight, wavy, curly and coily, including 4c. The cuticle is the same structure on every curl pattern, so there is no pattern this fails on. What varies is the conditions you use it in and how closely you follow the directions, as set out in section 12.

3. Accuracy of information

We work to keep the information on this site correct and current, but errors happen. Product photographs, illustrations, descriptions, ingredient listings, size and volume information, stock availability, shipping estimates and prices may at times contain inaccuracies, typographical mistakes or omissions.

Colors and finishes shown on a screen can differ from the physical product because monitors, phones and browsers render color differently. Packaging, labeling and formulation details can also change over time, so the label on the bottle you receive is the version to rely on.

We may correct any error, update any information and change any content on this site at any time without prior notice, including after you have submitted an order. Where an error materially affects an order you have already placed, we will contact you before we ship, and you may confirm the corrected order or cancel it for a full refund.

4. Pricing and payment

All prices are shown in United States dollars unless we clearly state another currency. Unless the page says otherwise, prices do not include shipping charges or any sales tax, duties or import charges, which are calculated and shown at checkout or explained in our Shipping Policy.

By submitting an order you authorize us, and our payment processors, to charge your chosen payment method for the full amount of that order, including the price of the products, any applicable tax and any shipping charge shown at checkout.

Payments are handled by third party payment processors. We do not store complete card numbers on our systems. Your use of a payment method is also subject to the terms of your card issuer, bank or wallet provider.

Prices, offers and promotions can change at any time. Bundle pricing and promotional pricing are time limited and may end or change without notice. A price change does not apply retroactively to an order that has already been placed and paid for, and we are not able to apply a later discount to an earlier order.

If a payment is declined, reversed, charged back or otherwise fails, we may cancel or hold the order and may decline future orders from the same account, email address or payment method.

5. Orders

Your order is an offer to buy the products in it. It is not a binding contract until we accept it. The email you receive after checkout confirms that we have received your order and taken payment. It is not by itself acceptance. The contract between us is formed when we ship the order.

We may accept, refuse, limit or cancel any order, in whole or in part, including where:

• we suspect fraud, or the unauthorized use of a payment method,

• the billing or delivery details cannot be verified, or the address fails verification with the carrier,

• the ordering pattern suggests purchase for resale rather than personal use, including bulk orders, repeated orders to the same address, or orders that appear to be placed for a reseller,

• a quantity limit applies to a promotion or to a product and the order exceeds it,

• a price, description or promotional offer was published in error,

• we are unable to ship to your location, or shipping there would breach applicable law, or

• you have breached these terms.

If we cancel an order after your payment method has been charged, we will refund the full amount charged to the original payment method. If we cancel part of an order, we refund the value of the canceled part. We are not liable to you for any other loss arising from a refused or canceled order.

6. Shipping, returns and refunds

Delivery timing, delivery areas, shipping charges, tracking and what happens if a parcel is delayed, lost or returned to sender are set out in our Shipping Policy. Returns, exchanges, refunds and how a refund is calculated are set out in our Refund Policy. Both documents are incorporated into these terms by reference and apply to every order.

Our guarantee is 30 days from the date your order is delivered. That is the only guarantee period we offer, and it is the same number on every page of this site. If the system is not right for you, contact us within that window and we will make it right on the terms described in the Refund Policy.

Returns must be authorized before anything is sent back. Email support@ellerand.com first. We will reply with the return instructions and the return address along with your authorization. We do not publish a return address, and a parcel sent back without authorization may not be traceable to your order and may not be refunded.

Where these terms and a policy document appear to conflict on a shipping, return or refund question, the policy document applies.

7. Promotions, discounts and bundles

From time to time we offer discount codes, bundle pricing, free shipping thresholds and free gift items. The following rules apply to all of them unless the offer itself says otherwise in writing.

• Only one discount code may be used per order. Codes cannot be combined with each other or stacked on top of bundle pricing unless we state that they can.

• Codes have no cash value, cannot be exchanged for cash, and cannot be applied to an order after that order has been placed.

• Offers may be limited by time, by quantity, by product, by customer or by region, and may end or change without notice.

• If your order included a free gift item and you return the order or the bundle it belonged to, the free item must be returned as well. If it is not returned, its stated value is deducted from your refund.

• If a partial return brings the remaining order below the threshold that earned a discount, free shipping or a free item, the discount may be recalculated and the difference deducted from your refund.

• We may cancel or void a code that has been shared publicly without our permission, generated automatically, or used in a way the offer was not intended for.

8. Intellectual property

All content on this site belongs to Ellerand or to our licensors. That includes the written copy, product descriptions, photographs, illustrations, diagrams, video, page design and layout, and the underlying code. It is protected by copyright, trademark and other laws.

The name Ellerand, the Ellerand logo, the product names we use including Ellerand Curl-Safe Smoothing System, and our other marks and taglines are our property. Nothing on this site grants you a license to use them.

You may view the site and share links to it for your own personal use. You may not copy, reproduce, republish, sell, rent, sublicense or exploit any part of the site or its content commercially. You may not use our photographs, copy or marks in your own listings, storefronts, advertising or social accounts, and you may not register a domain name, handle or business name that uses our marks or suggests that we endorse or supply you, in each case without our prior written permission.

9. Acceptable use

You agree to use this site lawfully and honestly. In particular, you agree not to:

• use the site for any unlawful purpose, or in breach of any applicable law or regulation,

• place fraudulent orders, use a payment method you are not authorized to use, or make false claims about an order, a delivery or a return,

• impersonate another person, or misrepresent your affiliation with any person or organization,

• attempt to gain unauthorized access to the site, to any account, or to any system or network connected to it,

• use robots, spiders, scrapers or other automated means to access, copy, monitor or index the site or to harvest data or prices from it,

• reverse engineer, decompile or interfere with any part of the site or its security features,

• upload or transmit any virus, malicious code or anything designed to damage or overload the site,

• abuse, threaten or harass anyone at Ellerand, our customers or anyone else through our site or our support channels, or

• resell our products, or present yourself as an authorized retailer or distributor of them, without our written permission.

We may investigate any suspected breach and may suspend or terminate your access, cancel your orders, block your address or payment method, and report the matter to the relevant authorities.

10. User content

You may be able to submit content to us or to our site, including photographs, video, questions, comments and the messages you send us at support@ellerand.com. We call all of that "user content".

You keep ownership of your user content. By submitting it, you grant Ellerand a worldwide, royalty free, perpetual, irrevocable, sublicensable and transferable license to use, store, reproduce, adapt, edit, translate, publish, distribute and display that content on our site, in our marketing and in our advertising, in any media, without further permission or payment to you.

By submitting user content you confirm that:

• it is your own content, or you have all the rights and permissions needed to grant the license above,

• anyone identifiable in a photograph or video has agreed to appear in it and to its use as described here,

• it does not infringe anyone's copyright, trademark, privacy or other rights,

• it is honest and reflects your genuine experience, and

• it is not unlawful, defamatory, misleading, obscene, hateful or harassing, and it does not make medical claims about our products.

We are not obliged to publish, keep publishing or respond to any user content. We may refuse, remove, shorten or edit user content for length, clarity or compliance, at our discretion and without notice. Removing content does not end the license you granted for any copy already published. User content you send us is not confidential, and sending it does not create any obligation of confidence on our part. If you want us to take down something you submitted, email support@ellerand.com and we will consider the request.

11. Third party links

Our site may contain links to sites and services we do not own or control, including payment providers, shipping carriers, social platforms and analytics providers. Those links are provided for convenience.

We do not control and are not responsible for the content, products, pricing, availability, terms or privacy practices of any site we link to. Once you leave our site, the other operator's terms and privacy policy apply to you, not ours. Please read them before you share personal information or make a purchase there. Any dealings you have with a third party you reach through our site are between you and that party.

12. Disclaimer of warranties

To the fullest extent permitted by applicable law, this site and our products are provided on an as is and as available basis, and we disclaim all warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title and non infringement. We do not offer a product warranty of any length. What we offer is the 30 day guarantee described in section 6, and that stands on its own.

We do not warrant that the site will be available without interruption, that it will be free of errors, or that any defect will be corrected.

Results vary from person to person. The system is for all hair types, and that does not change. What varies is everything around it: your water, your climate, the humidity where you live, how often you wash, how you dry your hair, how much product you use and how closely you follow the directions. Because of that, we cannot and do not promise any specific result for any individual, and we do not put a timeline on it.

Nothing in this section excludes or limits any right or remedy that cannot be excluded or limited under the law that applies to you as a consumer.

13. Limitation of liability

To the fullest extent permitted by applicable law, Ellerand and its owners, officers, employees, contractors, agents and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, loss of revenue, loss of data, loss of goodwill or cost of substitute goods, arising out of or connected with your use of the site, your purchase of a product, or your use of a product, whether the claim is based in contract, in tort including negligence, in strict liability or otherwise, and whether or not we were advised that such damages were possible.

Our total aggregate liability to you for any claim relating to a product is limited to the amount you actually paid us for that product.

Some jurisdictions do not allow the exclusion or limitation of certain damages or of implied warranties. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing here affects your mandatory legal rights as a consumer.

14. Indemnification

You agree to indemnify, defend and hold harmless Ellerand and its owners, officers, employees, contractors and agents from and against any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of or connected with:

• your breach of these terms or of any policy incorporated into them,

• your use of the site or of any product in a way these terms or the product label do not permit,

• your violation of any law or of the rights of any other person or organization, or

• any user content you submit.

We may, at our own cost, take over the exclusive defense and control of any matter that is subject to indemnification by you, and you agree to cooperate with us in that defense. You will not settle any such matter in a way that imposes an obligation on us without our written consent.

15. Privacy

Our Privacy Policy explains what personal information we collect when you browse the site, contact us or place an order, why we collect it, who we share it with, how long we keep it and the choices you have. It forms part of these terms. By using the site you also agree to the practices described in that policy.

16. Governing law

These terms, and any dispute or claim arising out of them, out of your use of this site, or out of any product you buy from us, are governed by the laws of the State of Alabama, United States, without regard to its conflict of law rules. You and we agree that the state and federal courts located in the State of Alabama have jurisdiction, subject to the paragraph below.

We ship to the United States and to most of the world. If you are a consumer resident outside the United States, nothing in this section removes the protection of the mandatory consumer laws of the country, state or province where you live. You keep the benefit of those laws, and you may be able to bring proceedings in the courts of your own country. Where a mandatory consumer protection that applies to you conflicts with anything in these terms, that protection applies.

17. Changes to these terms

We may update these terms as our store, our products and the law change. When we do, we will post the updated version on this page and change the "Last updated" date at the top.

The version published on this page at the time you use the site governs that use, and the version in effect when you place an order governs that order. Changes are not retroactive. If you continue to use the site after an update is posted, you accept the updated terms. Please check this page from time to time so you know where you stand.

18. Severability and general

If any provision of these terms is found to be unlawful, void or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.

If we do not enforce a right or provision of these terms, that is not a waiver of that right or provision, and it does not prevent us from enforcing it later.

These terms, together with the Shipping Policy, the Refund Policy and the Privacy Policy, are the entire agreement between you and Ellerand about the site and your orders, and they replace any earlier understanding on the same subject.

You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign ours in connection with a merger, an acquisition or a sale of the business or its assets. Section headings are for convenience only and do not affect how these terms are read.
